The changes took effect on 11 March 2026 and relate to swimming pool safety information that must be included in sale and rental certificates:
- New definitions have been introduced for a “complete exemption” and a “partial Ministerial exemption” which apply where a regulated swimming pool is completely or partially exempt from safety requirements under the Building Act 2004.
- The term “compliance certificate” has been replaced with “compliance status certificate” —meaning that the certificate can confirm whether a swimming pool is compliant or non-compliant.
Certificates issued before 11 March 2026 remain valid. However, if an owners corporation is required to update or reissue a certificate from that date onwards, it must ensure the updated certificate complies with the new determinations.
