New sale and rental certificate determinations for the ACT: Swimming pool safety compliance

If you are a lot owner in the ACT, you may be aware that in March 2026, the ACT Government has updated the Unit Titles (Management) Sale Certificate Determination and the Unit Titles (Management) Rental Certificate Determination. 
These are the certificates that an owners corporation must prepare under section 119 of the Unit Titles (Management) Act 2011 when a unit is being sold or leased.  

The changes took effect on 11 March 2026 and relate to swimming pool safety information that must be included in sale and rental certificates:  

  • New definitions have been introduced for a “complete exemption” and a “partial Ministerial exemption” which apply where a regulated swimming pool is completely or partially exempt from safety requirements under the Building Act 2004. 
  • The term “compliance certificate” has been replaced with “compliance status certificate” —meaning that the certificate can confirm whether a swimming pool is compliant or non-compliant.  

Certificates issued before 11 March 2026 remain valid. However, if an owners corporation is required to update or reissue a certificate from that date onwards, it must ensure the updated certificate complies with the new determinations.
